They are on the hook. The railroad may or may not chose to 'set' the hook. I work for a large utility company and my company always tries to collect when someone damages the prperty, such as a car damaging a utility pole.

with a car its a bit easier your going after a registerd and insured vehicle.
905 OF ATV'S is not insured.

It doesn't really matter if the ATV is insured or not. The railroad can still sue the owner, it's just that without insurance the owner is SOL and may end up with a lien on his house or a garnishee of his pay from the judgement.

In my opinion, the railroad should make a public example of Evel Knievel Jr. and take him to court. The next one may not make it off his ATV in time.
