In additional news, the Grafton News is reporting that the town has been ordered to repay all the court costs to the G&U and the STB. How much more money do they expect to have to waste on a SCOTUS appeal, assuming they even bother hearing a case that's been decided three times over already?

Incorrect. We in EB don't have to go to the STB, while the NBRR would and there have been no filings. There is no preemption, as the line was abandoned legally through ICC in 1972, NBRR is at best a landowner, and NOT a RR. Totally different scenario than G&U as that line was not legally abando...

I don't think it would be the town paying taxes to itself. Probably taxes being paid to the state and/or the feds...
