This has been done many times before: If you erect the fence, you must maintain it. If you don't erect the fence, you're creating an attractive nuisance.

There is no real way to win this unless you have an extremely reasonable jury....which is why most companies just settle.

I can respect that they want to make sure there are a sufficient amount of new sleepers available for protection, but we do have 4 new sleepers delivered. It would be nice if they deployed one on each set of the Cardinal and deadhead it back to HIA as necessary.

My somewhat out of date 1996 Amtrak employees timetable shows 90 MPH Bergen to the eastward limits of Hudson and 70 MPH over the Portal Bridge. While I've heard the speed over Portal Bridge has been dropped it's quite possible the rest of it is still 90 MPH. I seriously doubt speeds on the High Lin...

There is still a shortage of parts for this equipment and a lot of them are specialized. They lack traps and have a fixed amount of seating. They would be an expensive addition to any fleet. They will be stored at Bear until the "surplus sale",may or may not be used as a surge fleet for the Holiday season. I seriously doubt they plan to do an expensive overhaul on a set just to use it a few days a year....particularly if they are considering limiting service to avoid the cost...
