Knoxville Locomotive Works has introduced another "green" roadswitcher locomotive: the KLW SE32C.

Highlights:

V16 MTU 4000 Series engine rated at 3,200 bhp, Tier 3
6 axles (based on EMD or GE cores)
Weight up to 420,000 LBs
ZF gearbox, AR10 alternator, TMV control systems

I would assume that it's legal on the basis of the locomotive perhaps being classified as a rebuild rather than a brand new locomotive.

As to what makes a rebuild…
Sounds like a plausible guess. Since the original carbody structure, and most of the original electicals (traction motors, generator) are used, these would be (at a guess, repeat GUESS) somewhere between a third and a half original by value, so maybe that is enough. Canadian Pacific's new yard power (2000 hp ECO engines from EMD, locomotive built on new frames, but maybe trucks and traction motors recycled) apparently count as rebuilds under Canadian law.

KLW seems to recycle the trucks,underframe,traction motors,main altenator,and parts of the carbody,
New prime mover,wiring,traction control system,and fuel tank when needed.
