I was just recently browsing some pictures of MARC equipment online, and noticed that MARC's GP40-2WH's and the Kawasaki bi-level cab cars both lack ditch lights. How is this possible in this day in age?

I did notice that the older Geeps, the Sumitomo cabs, and the electrics all have them. Can someone shed some light on how MARC gets around this rule?

There's a rule that states if they have mars lights they don't need ditch lights.

it has to do with when a unit was rebuilt

I think if the unit was rebuilt and equipped with mars lights or strobes prior to 1995 then it it excempt until its next rebuild.
