BENTON — U.S. Sen. Charles Schumer, D-N.Y., has called on the federal Surface Transportation Board to get Finger Lakes Railway’s cars off the tracks in Benton.Again, they're all up in the railway's face like they own it.
The railway recently moved 50 third-party center beam lumber cars onto track space being leased by other companies that aren’t currently using the cars. The railway plans to move about 200 into the town.
The town has issued a cease and desist order to the railway and asked it to file for a use variance, but an attorney for the railway has stated the company doesn’t have to follow local codes because the Surface Transportation Board has jurisdiction over the tracks.
